This bill creates a new law by adding a new section to chapter 41.50 RCW that changes the timing of state retirement benefit payments after a retiree's or beneficiary's death. Under the bill, the Department of Retirement Systems must continue paying the retiree’s or beneficiary’s state retirement benefits through the last day of the month in which the retiree or beneficiary dies. When survivor benefits apply, they would begin on the first day of the month following the month of death. The rule applies to all benefit payments the department issues, including optional annuities. The department may still require the beneficiary, survivor, or estate to refund any benefit payments made after the month of death. The change is expressly prospective: people who repaid benefits before January 1, 2026, are not entitled to refunds of those prior repayments. The act is set to take effect January 1, 2026, and it applies to retirees and beneficiaries covered under RCW chapters 2.10, 2.12, 41.26, 41.32, 41.35, 41.37, 41.40, and 43.43. There is some uncertainty about the exact placement of the new section within chapter 41.50 RCW.
